These Terms of Service govern your access to and use of the Awkar website, content, subscriptions, contributions, reader accounts and related services.

Awkar is operated by AWKAR LEGAL PTY LTD, ABN 29 659 399 523 and ACN 659 399 523 (“Awkar”, “we”, “us” or “our”).

By accessing or using https://www.awkarco.com.au/, registering as a reader, purchasing a subscription or making a contribution, you agree to these Terms.

If you do not agree, you should not use the website or purchase a subscription.

1. About Awkar

Awkar provides legal information, articles, commentary, analysis and information about legal services.

Content may include reporting, opinion, legal discussion, general guides and contributions from different authors. Opinions expressed by individual authors are their own and do not necessarily represent the views of Awkar or AWKAR LEGAL PTY LTD.

2. Eligibility

You must be legally capable of entering into an agreement to purchase a subscription or make a contribution.

If you are under 18, you should use paid Awkar services only with the permission and supervision of a parent or legal guardian.

You must provide accurate information when registering or purchasing a service.

3. Reader accounts

Some content or features may require you to sign in with a Google account or register through Google Reader Revenue Manager.

You are responsible for:

  • Maintaining the security of your Google account.
  • Activity undertaken through your account.
  • Keeping your account and contact information accurate.
  • Notifying Google and Awkar promptly if you suspect unauthorised use.

You must not share subscriber-only access in a way that circumvents the subscription system or gives unauthorised access to others.

Google’s separate terms apply to your Google account and its payment and subscription services.

4. Subscriptions

Awkar may offer monthly, annual or other subscription plans. The applicable:

  • Price.
  • Currency.
  • Billing period.
  • Included access.
  • Trial period, if any.
  • Renewal arrangements.

will be displayed before you complete your purchase.

Unless clearly described as a one-time purchase, a subscription automatically renews at the end of each billing period until cancelled.

By purchasing an automatically renewing subscription, you authorise Google or its payment provider to charge the applicable subscription price and any disclosed taxes at the beginning of each renewal period.

Any introductory or promotional price applies only for the period stated in the offer. The ordinary price shown at purchase or otherwise notified to you may apply after that period.

5. Google Reader Revenue Manager and payments

Awkar uses Google Reader Revenue Manager to process subscriptions, contributions and reader registrations.

Google or its payment provider processes payments and may issue transaction confirmations and receipts. Your use of those services is also subject to Google’s applicable terms, payment terms and privacy policy.

Awkar does not ordinarily receive or store your complete payment-card details.

If Google rejects or reverses a payment, or if a subscription expires or is cancelled, your access to subscriber-only content may be suspended or ended.

6. Cancelling a subscription

You may cancel your subscription at any time using the subscription-management options associated with your Google account or by following the cancellation instructions supplied with your purchase.

You may also contact office@awkarco.com.au if you need help locating the appropriate subscription-management option.

Unless otherwise stated or required by law:

  • Cancellation stops future renewal charges.
  • You will ordinarily retain access until the end of the billing period for which you have already paid.
  • Deleting an Awkar account or unsubscribing from marketing emails does not necessarily cancel a paid subscription.
  • You should complete the cancellation process before the next renewal date to avoid the next charge.

Any cancellation confirmation issued by Google should be retained for your records.

7. Price changes

We may change subscription prices from time to time.

A new price will not be applied to an existing subscription without any notice or consent required by applicable law or Google’s subscription processes. Where required, you will be given an opportunity to cancel before the changed price takes effect.

8. Contributions

Awkar may invite voluntary financial contributions from readers.

Unless expressly stated otherwise, a contribution:

  • Is voluntary.
  • Does not purchase ownership, control or editorial influence.
  • Does not make the contributor a shareholder, partner or creditor of Awkar.
  • Is not represented as tax-deductible.
  • May be processed as a one-time or recurring payment, as clearly displayed before confirmation.

Recurring contributions may be cancelled through the applicable Google payment or membership controls.

Nothing in these Terms limits any refund or cancellation right that cannot lawfully be excluded.

9. Refunds and Australian Consumer Law

Except where required by law or expressly offered at purchase, payments are generally not refundable merely because you changed your mind or did not use the service.

However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

If you believe a payment was unauthorised, duplicated or incorrectly processed, or that the service was not supplied as promised, contact office@awkarco.com.au and the applicable Google payment-support service.

Where a refund is approved, it may be processed by Google or the original payment provider.

10. Availability and changes to the service

We aim to keep Awkar available and accurate, but we do not promise that:

  • The website will always be available or uninterrupted.
  • Every error will be corrected immediately.
  • Every article will remain permanently available.
  • Particular content will always be included in a subscription.
  • The website will be compatible with every device, browser or service.

We may add, remove, correct, archive or modify content and features where reasonably necessary. Material changes affecting a paid subscription will be handled consistently with applicable consumer law.

Content published on the Awkar website is provided for general information and educational purposes only.

Unless we expressly agree otherwise in writing:

  • Website content is not legal advice.
  • Reading an article or using the website does not create a solicitor-client relationship.
  • Sending an enquiry does not mean that Awkar has accepted your matter or agreed to act for you.
  • Information published on the website may not apply to your individual circumstances.
  • Laws and legal procedures may change after an article is published.
  • Legal outcomes depend on the facts and circumstances of each matter.

You should obtain advice from an appropriately qualified lawyer before relying on website information in relation to a legal matter.

Do not delay obtaining legal advice or meeting a legal deadline because of information published on this website.

Contacting Awkar does not automatically create a solicitor-client relationship.

A solicitor-client relationship will only arise after Awkar has:

  • Considered whether it can accept the matter.
  • Completed any required identity and conflict checks.
  • Confirmed in writing that it has agreed to act.
  • Provided any required costs disclosure or engagement documentation.

Until that process is complete, you should not assume that Awkar represents you or will take steps to protect your interests.

You are responsible for monitoring and complying with any limitation period, hearing date, filing deadline or other urgent legal requirement unless Awkar has expressly agreed in writing to manage it.

General website forms and ordinary email may not be appropriate for highly sensitive or urgent information.

Information sent before Awkar agrees to act may not necessarily be protected by legal professional privilege. You should avoid sending confidential documents or detailed sensitive information until Awkar confirms that it is appropriate to do so.

Awkar’s receipt of unsolicited information does not prevent it from acting for another person where legally and professionally permitted.

14. Corrections and editorial updates

Awkar may correct, clarify or update published material when errors or relevant new information are identified.

If you believe an article contains a significant factual error, contact office@awkarco.com.au and identify:

  • The relevant article.
  • The statement you believe is incorrect.
  • The reason it is incorrect.
  • Any reliable supporting evidence.

Submitting a correction request does not guarantee that an article will be altered or removed.

15. Intellectual property

Unless otherwise stated, Awkar or its licensors own the copyright and other intellectual-property rights in the website’s original content, branding, design and materials.

You may:

  • View Awkar content for personal, non-commercial use.
  • Share links to Awkar articles.
  • Quote limited portions for criticism, review, reporting, research or other purposes permitted by law, with appropriate attribution.

You must not, without prior written permission:

  • Republish complete articles or substantial portions of them.
  • Sell, license or commercially exploit Awkar content.
  • Remove copyright notices or attribution.
  • Systematically scrape, reproduce or create a database from Awkar content.
  • Use Awkar branding in a manner suggesting endorsement or affiliation.
  • Circumvent a paywall, access control or technical protection.
  • Use automated systems to extract content for training or developing commercial artificial-intelligence models, except where expressly authorised by us or permitted by law.

16. User submissions and comments

If Awkar allows comments, letters, corrections, images or other submissions, you retain ownership of your original material.

By submitting material for publication, you grant Awkar a non-exclusive, worldwide, royalty-free licence to store, reproduce, edit, format, publish, distribute and promote that material in connection with Awkar.

You confirm that:

  • You have the right to submit the material.
  • It does not infringe another person’s rights.
  • It is not knowingly false, defamatory, threatening, unlawful or malicious.
  • It does not contain malware, spam or deceptive links.
  • It does not improperly disclose another person’s private information.

We may moderate, refuse, edit or remove submissions where reasonably necessary. We are not required to publish or retain any submission.

17. Acceptable use

You must not:

  • Use Awkar for unlawful, fraudulent or abusive purposes.
  • Attempt to gain unauthorised access to the website, accounts or systems.
  • Interfere with the website’s operation or security.
  • Introduce malware or harmful code.
  • Harvest personal information from users.
  • Impersonate another person or misrepresent your affiliation.
  • Circumvent subscription, paywall or access restrictions.
  • Use bots or automated tools in a manner that creates an unreasonable load or violates instructions provided through robots.txt or similar controls.
  • Use Awkar content to harass, threaten or unlawfully discriminate against another person.

We may restrict or suspend access where we reasonably believe these Terms have been materially breached.

Awkar may link to third-party websites, products, sources and services. A link does not necessarily constitute endorsement.

We do not control third-party content, availability, security or privacy practices. Your use of third-party services is governed by their own terms.

Awkar may display advertising, sponsored material or affiliate links.

Where reasonably required, commercial relationships will be identified. If you make a purchase through an affiliate link, Awkar may receive a commission without increasing the price you pay.

Advertisers and third-party sellers are responsible for their own products, services and representations. Your transaction with a third party is separate from your subscription relationship with Awkar.

If you believe content on Awkar infringes your copyright, contact office@awkarco.com.au with:

  • Your name and contact information.
  • Identification of the protected work.
  • The URL and description of the allegedly infringing material.
  • An explanation of your rights in the work.
  • A statement that the information supplied is accurate.

We may request additional information before taking action.

21. Liability

To the maximum extent permitted by law, Awkar is not liable for indirect or consequential loss arising solely from reliance on general website content, third-party websites or events outside our reasonable control.

Any limitation in these Terms is subject to rights and remedies that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees.

Where we are permitted to limit a remedy for failure to comply with a consumer guarantee, our liability may be limited to resupplying the relevant service or paying the reasonable cost of having it supplied again.

These limitations do not replace or alter the terms of any separate legal-services agreement between you and AWKAR LEGAL PTY LTD.

22. Suspension and termination

You may stop using Awkar at any time. Paid subscriptions must be cancelled using the applicable cancellation process to prevent future renewal charges.

We may suspend or terminate access where reasonably necessary because of:

  • A serious or repeated breach of these Terms.
  • Fraud, payment reversal or unauthorised account activity.
  • A security or legal requirement.
  • Conduct that materially harms Awkar, its systems or other users.

Where appropriate and reasonably practicable, we will provide notice and an opportunity to remedy the issue.

Termination does not remove rights or obligations that arose before termination.

23. Changes to these Terms

We may update these Terms to reflect changes to Awkar, Google Reader Revenue Manager, applicable law, professional requirements or our business operations.

The current Terms will be published on this page with the updated date.

If a change materially disadvantages an existing paid subscriber, we will provide any notice and cancellation opportunity required by applicable law.

24. Governing law

These Terms are governed by the laws of the Australian state or territory in which AWKAR LEGAL PTY LTD principally operates, together with applicable Commonwealth laws.

The parties submit to the courts with jurisdiction in that state or territory, except where applicable consumer law gives you the right to bring a claim elsewhere.

25. Severability

If a provision of these Terms is found to be invalid or unenforceable, it will be read down or removed only to the extent necessary. The remaining provisions will continue to apply.
