There are several legal requirements that must be met before you can apply for a divorce.

One of the key requirements for the Court to grant a divorce is that you and your spouse have been legally separated and living separately and apart for at least twelve months, with no reasonable likelihood of reconciliation.

You may still be considered separated even if you continue living under the same roof during the twelve-month period; however, additional documents will be required to support your application.
