Divorce

In order to file or Divorce there are many legal requirements for obtaining a divorce. 

Awkar & Co can assist in the preparation, filing and serving of the Application of Divorce as well as attend the hearing on your behalf if required. We will be able to advise you on all aspects of the divorce process. 

One of the main legal requirements in order for the Court to be satisfied and grant the divorce is that you have been legally separated and living separately and apart for a minimum of twelve months and there is no likelihood of a reconciliation. 

You can be deemed separated if you remain living under the same roof within the twelve month period as your ex spouse, however additional documents will be required.
