Awkar & Co also acts in matters as an Independant Children's Lawyer in matters where the Court has Ordered an ICL to represent the best interest of the children.
An ICL is usually appointed in matters where the parents are unable to reach an agreement, or serious allegations have been made against either one or both parents.
The ICL takes on the view, similarly to the Court, that it does not matter who is to blame and the main concern is the best interest of the child/children. The ICL will be involved in all Court proceedings pertaining to the children.
Depending on the child/children's age, maturity and other relevant circumstances, the ICL may consider it appropriate to have a meeting and talk with the child/children.
The ICL does not side with either party, however may choose to support one parties case, if they believe it is in the best interest of the child.
Ultimately the decision on where the child/children will reside or any other parenting issue is with the Judicial Office. The Judicial Officer is not bound to accept or adapt the Independant Children's Lawyer's recommendations.
